Important Factor Considered Behind Scrapping of Article 370

Prime Minister Modi once again proved himself as an ideal Politian to ahead the nation. Firstly, the Chandrayaan – 2 then 3 Talak solutions and this week he comes up with dissolving of Article 370 belong to the state of Jammu and Kashmir. Whole Rajya Sabha debated over this clause that should it be abolished or not on Monday morning. The Presidential order used a clause of Article 370 provision would no longer be applicable in Jammu and Kashmir.

What was in Article 370?

If we talk about Article 370 it provides special benefits to Jammu and Kashmir, to have their own separate rules and regulations related to citizenship, ownership and fundamental rights. According to Article 370, the citizen’s other states than Jammu and Kashmir cannot buy land there. With the dissolving of Article 370 the Bifurcation of Jammu and Kashmir into two different Union Territories. Where Jammu and Kashmir become Union Territories with Legislative and Ladakh becomes the union territories without Legislative.

On Monday morning, in Rajya Sabha, home minister Amit Shah announced that the government was moving a Presidential order for Parliament’s ratification. He also said that the government was moving a bill to bifurcate the state of Jammu and Kashmir into two UTs – Jammu and Kashmir and Ladakh.

This decision from Prime Minister Modi became a historic turning point for Jammu and Kashmir. Now let’s discuss in brief that what happened on Monday in Rajya Sabha.

The Government moved a resolution to effectively abolish Article 370, which give special powers to the state of Jammu and Kashmir. The government also introduced a bill to divide the state into two Union Territories- Jammu Kashmir and Ladakh.

Now the question Arises that is Jammu and Kashmir is state or not?

According to the reorganization Bill which bifurcates the state into two Union territories. The Lok Sabha must press the bill, which will then go to the President for his assent. Once the President signs the Bill and the government issues a notification, Jammu, and Kashmir will no longer a state.

Article 370 supports these following facilities for the citizen of Jammu and Kashmir:

Special powers exercised by J&K.
Separate flag for Jammu and Kashmir.
Article 360 (Financial Emergency) not Applicable.
No reservations for minorities such as Hindu and Sikhs.
Indian citizens from other states can not buy land or property in J&K.
RTI not applicable.
Duration of Legislative assembly for 6 years.
If a woman from J&K marries out of state, she would lose the citizenship of the state.
Panchayats have no rights.
Right to Education was not applicable.

After the demolishing of Article 370, these changes can be noticed in the state policies.

No special powers from now.
Single Citizenship.
Tricolor will be the only flag.
Article 360 will be Applicable.
Minorities will be applicable for only a 16% reservation.
People from another state will now be able to purchase land or any property in J&K.
RTI will be applicable.
Assembly duration Union Territory of J&K will be for 5 years.
If a woman marries out of state or country, she will remain all her rights and Indian citizenship.
Panchayats will have the same rights as in other states they have.
Children in the state are benefited with the Right to education.

This is how Modi government once again swipe of the old road rules and come up with a new idea which necessary applicable for the development of India.
